Key point: Rhode Island enacted three AI-related bills, New Hampshire amended its consumer data privacy law, Pennsylvania’s consumer data privacy law advanced, and thirteen California bills passed out of committees.

This is the 24th update on the status of proposed state privacy and AI legislation in 2026.

What’s New

Rhode Island Governor Dan McKee signed three AI-related bills into law last week. Companion bills H 7350 and S 2195 regulate AI companion chatbots. The Use of AI by Healthcare Providers Notification Act (S 2570 / HB 7538) requires healthcare providers and facilities that use AI to document in-person or telehealth visits to notify patients of that use and to review the AI-generated documentation for accuracy. The Oversight of AI Technology in Mental Health Care Act (HB 7349 / S 2197) regulates the use of mental health chatbots.

Turning to consumer data privacy bill updates, New Hampshire Governor Kelly Ayotte signed a bill into law amending the state’s consumer data privacy law to prohibit the sale of children’s personal data.

Meanwhile, Pennsylvania’s consumer data privacy bill advanced out of a Senate committee. The bill previously passed the House.

Finally, three bills to amend the California Consumer Privacy Act (CCPA) advanced out of committees. The bills expand the CCPA’s right to delete, amend the law’s publicly available exemption, and prohibit the sale of sensitive personal information.

California lawmakers also advanced ten other bills through committee last week, including kids’ privacy and AI-related bills.

In other AI bill news, Arizona’s chatbot bill was vetoed by the Governor, Pennsylvania lawmakers advanced a chatbot bill out of committee, and New Jersey’s Fair Price Protection Act companion bills advanced.

Privacy Updates

Consumer Data Privacy

New Hampshire’s HB 1460 was signed into law by Governor Kelly Ayotte. The bill amends the state’s consumer data privacy law to prohibit the sale of children’s personal data. The bill takes effect January 1, 2027.

Pennsylvania’s consumer data privacy bill (HB 78) was advanced by the Senate Communications and Technology Committee. It is now on floor readings. The bill previously passed the House.

In California, the Assembly Privacy and Consumer Protection Committee advanced SB 435, which amends the CCPA’s publicly available exemption, and SB 923, which expands the CCPA’s right to delete. The Senate Privacy, Digital Technologies, and Consumer Protection Committee amended and advanced AB 1542, which prohibits a business, service provider, or contractor from selling sensitive personal information. All three bills are now with their respective Appropriations committees.

Kids’ Privacy

California’s AB 1709 (covered platforms: age restriction: e-Safety Advisory Commission) advanced out of the Senate Privacy, Digital Technologies, and Consumer Protection Committee to the Judiciary Committee.

AI Updates

Chatbot

Governor McKee signed Rhode Island’s companion chatbot bills (H 7350 / S 2195) into law.

Arizona’s chatbot bill (HB 2311) was vetoed by Governor Katie Hobbs.

Pennsylvania’s companion chatbot bill (HB 2006) was amended and advanced by the House Communications and Technology Committee.

In California, AB 2023 (companion chatbots) advanced out of the Senate Judiciary Committee to the Appropriations Committee. SB 1119 (companion chatbots) advanced out of the Assembly Judiciary Committee to the Privacy and Consumer Protection Committee. AB 1609 (customer service chatbots) advanced out of the Senate Privacy, Digital Technologies and Consumer Protection Committee to the Judiciary Committee.

Pricing

In New Jersey, the Fair Price Protection Act companion bills advanced. S 3612 was reported out of the Senate Budget and Appropriations Committee while A 4085 was reported out of the Assembly Appropriations Committee.

California’s AB 2564 (surveillance pricing) advanced out of the Senate Privacy, Digital Technologies, and Consumer Protection Committee to the Judiciary Committee.

Rhode Island’s two health-related AI bills were signed into law by Governor McKee: Use of AI by Healthcare Providers Notification Act (S 2570 / HB 7538) and the Oversight of AI Technology in Mental Health Care Act (HB 7349 / S 2197). California’s SB 1146 (health-related consumer products and services: digital replicas and synthetic performers) advanced out of the Assembly Judiciary Committee to the Appropriations Committee. AB 2575 (health care services: AI) advanced out of the Senate Labor, Public Employment and Retirement Committee to the Privacy, Digital Technologies, and Consumer Protection Committee. AB 1979 (GenAI: training data: copyrighted materials) advanced out of the Senate Judiciary Committee to the Appropriations Committee.
